Establishing that Heart and Lung Benefits are not subject to subrogation;

Establishing a Workers' Compensation Insurer's liability for bad faith and punitive damages;

Establishing that New Jersey anti-subrogation Law is saved from ERISA preemption under ERISA's Savings Clause;

Derek Smith, Esq.
Derek graduated from the Pennsylvania State University Dickinson School of Law in Carlisle, Pennsylvania in 2015.
He joined the the Law Office of Charles Kannebecker as an associate in 2016, initially focusing on personal injury litigation before expanding outward to include ERISA and Heart & Lung Act litigation.
He has assisted in a broad variety of matters, including motor vehicle and tractor-trailer accidents, premises liability, and insurance coverage issues.
Recently, Derek has been involved in litigation holding insurers accountable for their intentional violations of Pennsylvania law, as well as litigation preventing insurance companies and third-party administrators from stealing money from their own insureds’ personal injury recoveries.
Derek is a member of the Pennsylvania Bar Association and the Pennsylvania Association for Justice.
Timothy McMahon, Esq.
Tim has developed over 30 years of experience in a multitude of litigation areas, including personal injury, trucking and transportation litigation, professional liability, and products liability.

Tim is a graduate of Richard Stockton College. He attended the Dickinson School of Law where he received his Juris Doctorate Degree in 1988.

Tim has been named a Pennsylvania Super Lawyer for 2005, 2006, 2009-2018 in the area of Civil Litigation Defense.
Tim joined the Law Office of Charles Kannebecker in 2021, bringing with him decades of experience.
Significant Representative Matters:
· Successfully defended through trial a product liability action involving catastrophic head injuries sustained by a 5-year-old child where potential exposure was in excess of $5 million.
· Successfully resolved a multi-party, complex legal malpractice action involving more than 10 years of underlying litigation over a family trust with a gross value in excess of $10 million.
· Tried to defense verdict, after a six-week jury trial, an action involving a quadriplegic, persistent vegetative state plaintiff in a multi-party medical malpractice matter.
